Changes in healthcare financing increasingly rely upon patient cost-sharing to control escalating healthcare expenditures. These changes raise new challenges for physicians that are different from those that arose either under managed care or traditional indemnity insurance. Historically, there have been two distinct bases for arguing that physicians should not consider costs in their clinical decisions—an “aspirational ethic” that exhorts physicians to treat all patients the same regardless of their ability to pay, and an “agency ethic” that calls on physicians to (...) be trustworthy advisors to their patients. In the setting of greater patient cost-sharing, physicians' aspiration and agency roles increasingly conflict. Satisfactorily navigating the new terrain of consumer-driven healthcare requires physicians to consider these two roles and how they can best be reconciled so as to maximize quality of care while respecting the heterogeneity of patients' financial resources and willingness to pay. The development of natural theology in the Middle Ages was driven by the rebirth experienced by Western Europe beginning in the 1000s owing to the emergence of stable monarchies and reconquest of the Iberian Peninsula. This expansion gave scholars access to the vast libraries of scientific and philosophical literature held in Arabic cultural centres – libraries that contained Aristotelian works on natural, ethical, and metaphysical sciences, which had for centuries been lost to the Latin West. The new texts fed the (...) growth of universities, where secular interests helped shape the curriculum, as the centre of intellectual gravity shifted from the monastery to the town. This chapter examines the figures that represent various moments in the medieval tradition, during and after these developments. Anselm and Abelard immediately predate the universities and recovery of Aristotle. Aquinas and John Duns Scotus write on either side of the Condemnations of 1277. Raymonde of Sabunde's work first applies the expression ‘natural theology’ to Christian practice, and Yves of Paris seeks late into the seventeenth century to revitalize this project. In 1277, Stephen Tempier, bishop of Paris, drafted the famous Condemnation of 219 articles in theology and natural philosophy. This Condemnation was a reaction against a group of theologians, led by Siger of Brabant, who were accused of holding that truths of reason could contradict those of revelation. Writing before the Condemnation, which impugned reason's autonomy, Thomas Aquinas critiqued Siger and his followers, and argued that reason could never generate truths that contradict revelation. As a consequence, Aquinas sometimes dwells on (...) reason's limits, terming our knowledge of God 'equivocal' or 'analogical'. Sitting on the other side of the Condemnation, around the turn of the fourteenth century, John Duns Scotus was concerned to secure for reason a portion of its lost dignity. Accordingly, he explores what we can know of God, and lays claim to 'univocal' knowledge of him. Some scholars hold that Scotus's claim to univocal knowledge of God puts him at odds with Aquinas. In this dissertation, I argue that this is not the case, that this apparent discord is largely the result of their different enterprises rather than their basic beliefs about our natural knowledge of God, that Scotus's discussion of univocity is targeted not at Aquinas, but rather at Henry of Ghent---the leading light of the University of Paris at the time that Scotus studied there---and that Scotus does not believe that our knowledge of God is univocal in a strong sense, such that he would claim that it is wholly accurate. Rather, Scotus believes that, in this life, our knowledge of God must comprise abstract concepts that can never do justice to their source. This being the case, he has more in common with Aquinas than some would allow. (shrink)

The end of Benjamin Fondane's iconic poem, the ‘Préface en prose’, is inscribed at the entrance of Yad Vashem's Hall of Names. The quote is a resonant call to recognize the humanity of all victims in the poet's human countenance. This reference, among many other elements in this poem, prompts a comparison to Emmanuel Levinas's philosophy. The poem's speaker specifically resembles Levinas's ‘Other’. Contrary to Levinas, it is maintained that written discourse, and not just the face-to-face encounter, involves an (...) ethical summons, implying a responsibility on the part of the reader: the responsibility to commemorate, in this case to commemorate the innocent humanity murdered in the Shoah. The venerable cities of the past, such as Venice or Amsterdam, convey a feeling of wholeness, an organic unity that surfaces in every detail, large and small, in restaurants, shops, public gardens, even in balconies and ornaments. But this sense of wholeness is lacking in modern urban design, with architects absorbed in problems of individual structures, and city planners preoccupied with local ordinances, it is almost impossible to achieve. In this groundbreaking volume, architect and planner Christopher Alexander presents a (...) new theory of urban design which attempts to recapture the process by which cities develop organically. To discover the kinds of laws needed to create a growing whole in a city, Alexander proposes here a preliminary set of seven rules which embody the process at a practical level and which are consistent with the day-to-day demands of urban development. He then puts these rules to the test, setting out with a number of his graduate students to simulate the urban redesign of a high-density part of San Francisco, initiating a project that encompassed some ninety different design problems, including warehouses, hotels, fishing piers, a music hall, and a public square. This extensive experiment is documented project by project, with detailed discussion of how each project satisfied the seven rules, accompanied by floorplans, elevations, street grids, axonometric diagrams and photographs of the scaled-down model which clearly illustrate the discussion. A New Theory of Urban Design provides an entirely new theoretical framework for the discussion of urban problems, one that goes far to remedy the defects which cities have today. (shrink)

Given the extraordinary influence of the DSM-III and its successors, the DSM-III-R and the DSM-IV, it behooves humanistically oriented practitioners to appraise these new manuals most carefully. Toward this end, we discuss the goals that have guided the manuals' development and provide an overview of their basic structure. This is followed by a phenomenologically based critique, evaluating the claim that these manuals are "descriptive" and "atheoretical." We conclude with a discussion of five guiding principles for phenomenological diagnosis and assessment.

Performing Madness: The Clinic as Stage. In the second half of the nineteenth century, clinical demonstrations became the dominant teaching method in psychiatry, playing a key role in medical‐professional disputes, as well. This paper traces this widely used though historiographically neglected practice of knowledge implementation and mediation, as demonstrated in the psychiatric clinic of the Berlin Charité (Psychiatrische und Nervenklinik der Berliner Charité) from 1881 to 1927. Documentation of this practice, found within individual medical records, forms the basis of this (...) research. The concept of ‘theatricality’ assists in uncovering the dramatic quality of the clinical demonstration: Psychiatric knowledge was not simply disseminated through such a practice; rather, such knowledge was first performatively created through the very logic of its presentation of exemplary patient histories, as well as through the examination and diagnostic positioning of its patients. The ‘success’ of such presentations depended on many variables, related to staff, time, place, and other situational factors. These include the presence of appropriate lecture halls, the availability and calculated selection of patients, and the employment of specific performative techniques by doctors for the sake of producing desired results. As one effect, clinical demonstrations also encouraged patients to both learn and rehearse behavior considered relevant to the particular diagnosis that was to be demonstrated. (shrink)

[First paragraphs: This essay takes its practical orientation from my experiences as a member of a philosophy reading group on death row at Riverbend Maximum Security Penitentiary in Nashville, Tennessee. Its theoretical orientation comes from W. E. B. Du Bois’ lecture-turned-essay, “Criteria of Negro Art,” which argues that the realm of aesthetics is vitally important in the war against racial discrimination in the United States. And since, according to Michele Alexander’s critically-acclaimed The New Jim Crow: Mass Incarceration in the (...) Age of Colorblindness, the prison system should be the primary front today in this war, my essay’s ultimate aim is t/o articulate a new criterion of the present-day “Negro” art being created by a prison population that is still overwhelmingly constituted by persons of color. In my first section, I will show how Du Bois’ insights in “Criteria of Negro Art” remain relevant today, especially in the prison context, and argue that it is thus appropriate for my new criterion to be shaped by his distinctive conception of “propaganda.” In my second section, through a close reading of two texts by Michel Foucault (the pivotal thinker of modern imprisonment), I will flesh out this new criterion, “self-torsion,” defined as the effect of prisoners’ attempts at self-care within a prison system that distorts those attempts into further exploitation of both prisoners and the outside world that imprisons them. And my final section, in an attempt to illustrate this new criterion’s efficacy as a form of propagandistic resistance to contemporary racism, will deploy self-torsion as a critique of two artworks created by imprisoned members of my reading group at Riverbend penitentiary. Several writers have argued recently that optimal rules of law authorize morally suboptimal decisions in certain cases.1 Larry Alexander calls these “gap cases.”2 Should judges in gap cases defer to legal rules or deviate from them? Philosophers known as “formalists” favor deference, “particularists” favor deviation.

This slim volume contains a collection of eight essays that were originally given as lectures in 2002 under the aegis of the Society for Medieval Logic and Metaphysics. It is the second in a series of nine volumes published thus far, on subjects such as mental representation, free will, the ontology of individuation, the conceivability of God, skepticism, and nominalism. The title of the present volume is slightly misleading. The impact of the Salters’ Hall Synod went beyond its immediate context in England and spread throughout the British Isles and into Ireland. Ulster Presbyterianism was wracked with debate over confessional subscriptionism and Unitarianism. Two key interlocutors in this debate were the Unitarian theologian William Hamilton Drummond and his orthodox counterpart, Alexander Carson. Whether or not quantum physics can account for molecular structure is a matter of considerable controversy. Three of the problems raised in this regard are the problems of molecular structure. We argue that these problems are just special cases of the measurement problem of quantum mechanics: insofar as the measurement problem is solved, the problems of molecular structure are resolved as well. In addition, we explore one consequence of our argument: that claims about the reduction or emergence of molecular structure (...) cannot be settled independently of the choice of a particular resolution to the measurement problem. Specifically, we consider how three standard putative solutions to the measurement problem inform our under- standing of a molecule in isolation, as well as of chemistry’s relation to quantum physics. While it might seem prima facie plausible that divine foreknowledge is all that is needed for prophecy, this seems incorrect. To issue a prophecy, God hasto know not just how someone will act, but how someone would act were the prophecy issued. This makes some think that Middle Knowledge is required.I argue that Thomas Flint’s two Middle Knowledge based accounts of prophecy are unsatisfactory, but one of them can be repaired. Can there be grounding without necessitation? Can a fact obtain wholly in virtue of metaphysically more fundamental facts, even though there are possible worlds at which the latter facts obtain but not the former? It is an orthodoxy in recent literature about the nature of grounding, and in first-order philosophical disputes about what grounds what, that the answer is no. I will argue that the correct answer is yes. I present two novel arguments against grounding necessitarianism, and show that grounding (...) contingentism is fully compatible with the various explanatory roles that grounding is widely thought to play. Causation is a deeply intuitive and familiar relation, gripped powerfully by common sense. Or so it seems. As is typical in philosophy, however, that deep intuitive familiarity has not led to any philosophical account of causation that is at once clean, precise, and widely agreed upon. Not for lack of trying: the last thirty years or so have seen dozens of attempts to provide such an account, and the pace of development is, if anything, accelerating. (See Collins et al.
